Maintenance of law and order and providing safety and security to all citizens is primarily the subject matter of State Governments concerned.

The framework of existing laws such as Indian Penal Code, Criminal Procedure Code etc. is considered adequate to provide for safety and security to all citizens, including RTI activists.

Government of India has drawn the attention of State Governments to the reports appearing in the media about the victimization of people, who use RTI to expose corruption and irregularities in administration.

The Whistle Blowers Protection Act, 2014 has been notified on 12th May, 2014. As the Act required amendments aimed at safeguarding against disclosures affecting sovereignty and integrity of India, Security of the State, etc., before it is brought into force, the Government introduced the Whistle Blowers Protective (Amendment) Bill, 2015 in the Lok Sabha which has been passed by the Lok Sabha on 13th May, 2015. The said Bill has been transmitted to the Rajya Sabha and is presently pending in the Rajya Sabha.

Corruption is the biggest evil in our country working as a pest for our economy for the longest time now.  One of the weaknesses when it comes to eradicating this menace from all sectors has been the nonexistence of passable safety to the person complaining about such bribery or deliberate mismanagement of authority or suspicious misappropriation of decision which grounds palpable forfeiture to the administration or commission of an illegal offence by a public servant.

As it was always felt that any person who comes forth and reports such misuse of power by a government official needs a decent amount of protection for doing the same. This will directly encourage the one reporting the crime and discourage the one committing it.  

Hence, keeping in mind all the issues prevailing in the social as well as economic sphere of the country, it was decided to pass a discrete legislature to offer suitable shield to anyone reporting bribery or intentional misappropriation of authority or decision that is expected to cause damage to the administration or the one who unveils the commission of a transgression by a public official. Moreover, it purposes at providing the method to inquire into such information as well as offer satisfactory protections against abuse of whistle-blowers and the people reporting such issues.
